Limitation of liability

To the fullest extent permitted by applicable law, in no event will Website Operator, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Website Operator has been advised as to the possibility of such damages or could have foreseen such damages. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

लागू कानून द्वारा अनुमत अधिकतम सीमा तक, किसी भी परिस्थिति में वेबसाइट संचालक, उसके सहयोगी संस्थान, अधिकारी, निदेशक, कर्मचारी, प्रतिनिधि, आपूर्तिकर्ता या लाइसेंसधारक किसी भी व्यक्ति के प्रति किसी भी प्रकार की अप्रत्यक्ष, आकस्मिक, विशेष, दंडात्मक या परिणामी हानि के लिए उत्तरदायी नहीं होंगे। इसमें लाभ, आय, बिक्री, प्रतिष्ठा, सामग्री के उपयोग, व्यवसाय पर प्रभाव, व्यवसाय में बाधा, अपेक्षित बचत की हानि अथवा व्यावसायिक अवसरों की हानि सहित किसी भी प्रकार की क्षति शामिल है, चाहे वह किसी भी कारण या किसी भी कानूनी आधार से उत्पन्न हुई हो, भले ही ऐसी हानि की संभावना की पूर्व सूचना दी गई हो या उसका पूर्वानुमान लगाया जा सकता हो। लागू कानून द्वारा अनुमत अधिकतम सीमा तक, सेवाओं से संबंधित किसी भी दावे के लिए वेबसाइट संचालक तथा उसके सहयोगी संस्थानों, अधिकारियों, कर्मचारियों, प्रतिनिधियों, आपूर्तिकर्ताओं और लाइसेंसधारकों की कुल उत्तरदायित्व राशि **₹100** या उस घटना से पूर्व के एक माह के दौरान आपके द्वारा वेबसाइट संचालक को वास्तव में नकद रूप में भुगतान की गई राशि, इनमें से जो अधिक हो, तक सीमित रहेगी। ये सीमाएँ और अपवाद उस स्थिति में भी लागू रहेंगे, जब उपलब्ध उपाय आपकी हानि की पूरी भरपाई न कर सके या अपने मूल उद्देश्य को पूरा करने में असफल रहे।

Indemnification

You agree to indemnify and hold Website Operator and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any willful misconduct on your part.

क्षतिपूर्ति

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

पृथक्करण

इस समझौते में निहित सभी अधिकार और प्रतिबंध केवल उसी सीमा तक लागू, प्रभावी और बाध्यकारी होंगे, जहाँ तक वे लागू कानूनों का उल्लंघन नहीं करते हैं। इनका उद्देश्य केवल आवश्यक सीमा तक सीमित रहना है, ताकि यह समझौता अवैध, अमान्य या अप्रवर्तनीय न बने। यदि सक्षम न्यायालय द्वारा इस समझौते का कोई प्रावधान या उसका कोई भाग अवैध, अमान्य या अप्रवर्तनीय घोषित किया जाता है, तो पक्षकारों का यह उद्देश्य होगा कि शेष प्रावधान उसी विषय-वस्तु के संबंध में उनके बीच का समझौता माने जाएँ, और ऐसे सभी शेष प्रावधान पूर्ण रूप से प्रभावी एवं लागू बने रहेंगे।

Dispute resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Maharashtra, India without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of India. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Mumbai ,Maharashtra, India, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

विवाद समाधान

इस समझौते का निर्माण, इसकी व्याख्या, इसका पालन तथा इससे उत्पन्न होने वाले किसी भी विवाद का निपटारा महाराष्ट्र, भारत के लागू विधिक एवं प्रक्रियात्मक कानूनों तथा जहाँ लागू हो, भारत के कानूनों के अनुसार किया जाएगा। इस समझौते से संबंधित किसी भी विवाद या कार्यवाही के लिए केवल मुंबई, महाराष्ट्र, भारत में स्थित न्यायालयों को विशेष अधिकार क्षेत्र प्राप्त होगा, और आप ऐसे न्यायालयों के अधिकार क्षेत्र को स्वीकार करते हैं। आप इस समझौते से संबंधित किसी भी कार्यवाही में जूरी द्वारा सुनवाई के अपने किसी भी अधिकार का त्याग करते हैं। अंतरराष्ट्रीय वस्तुओं की बिक्री संबंधी अनुबंधों पर संयुक्त राष्ट्र अभिसमय इस समझौते पर लागू नहीं होगा।

Changes and amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will post a notification on the main page of our Website. Continued use of the Website after any such changes shall constitute your consent to such changes.
